Terms of Service

This agreement

These terms are between you and Twodots Software Services OPC Private Limited — TwoDots, the company that operates Zocton — and they apply when you create a Zocton account or use any Zocton product: Zocton Accounts, the Zocton Dashboard, TurboWorkflow, PaceForms, MyMindNotes and ZeroCostCA. Using any of them means you accept these terms.

If you are agreeing on behalf of a company, you confirm you are allowed to bind it, and “you” means that company.

TraceFlow appears on this website but is not yet available. Nothing here applies to it until it launches.

Your account

You must be at least 16 and give accurate details. You are responsible for what happens under your account and for keeping your password to yourself. Tell us as soon as you think someone else has got into it.

When you sign up you choose a region for your workspace — North America, Europe or Asia Pacific — and a workspace address. That region is where your workspace runs.

Using Zocton properly

You agree not to use any Zocton product to:

• break the law, or infringe anyone's rights;
• send unsolicited bulk email, or anything a reasonable person would call spam;
• impersonate someone else, or misrepresent who a message is from;
• upload malware, or anything designed to damage a system;
• get at another customer's data, or at a part of our systems you have not been given;
• put a load on the service designed to degrade it for others;
• resell or white-label a Zocton product without our written agreement;
• or reverse engineer, copy or create a competing product from ours.

Sending through TurboWorkflow

TurboWorkflow sends email and LinkedIn messages from accounts you own, to people you supply. That puts real obligations on you, and they are the terms we will hold you to.

• Every contact must be lawfully yours. You confirm this when you import, and it is not a formality: you must have a lawful basis to contact each person, under the GDPR, the ePrivacy rules, CAN-SPAM, CASL, India's DPDP Act or whatever governs where they are.
• Every email carries an unsubscribe link and you may not remove it. The product offers no way to switch it off, and asking us to disable it is not something we will normally agree to.
• Opt-outs and bounces are final. A contact who unsubscribes is suppressed. An address that hard-bounces is suppressed permanently, and cannot be re-enabled.
• You are the sender. Mail leaves your own mail account, under your own domain and your own reputation. Complaints, blocklistings and deliverability are consequences you carry.
• Your mail provider's rules still apply. Google, Microsoft and LinkedIn each have terms about automated sending, and using TurboWorkflow does not exempt you from them.

Every email TurboWorkflow sends is tracked — an open pixel, and every link rewritten to pass through us. This cannot currently be switched off. Telling your recipients about it, where the law where they live requires that, is your responsibility. The Privacy Policy sets out exactly what is recorded.

Forms you build with PaceForms

You decide what a form asks and what happens to the answers. That makes you responsible for having a lawful basis to collect it, for telling the people filling it in what you will do with it, and for answering them when they ask about it.

PaceForms records each submitter's IP address, browser and referring page alongside their answers, and will email a submission to addresses you choose and post it to any webhook address you set. Those destinations are yours, chosen by you.

Your data stays yours

Everything you put into Zocton — your contacts, your emails, your form submissions, your notes, your recordings, your accounts and your files — remains yours. We claim no ownership of it.

You give us the permission we need to run the service for you: to store it, process it, back it up, and transmit it where you have told the product to send it. Nothing wider. We do not use your content to train AI models, and we do not sell it.

The software, design and brand of Zocton and its products remain ours.

Artificial intelligence in the products

TurboWorkflow can draft an email with an AI model when you ask it to, using an API key you supply for a provider you choose. That provider's terms govern that request, and their bill is yours.

MyMindNotes transcribes your recordings and organises the result using outside AI services, as a normal part of how it works. Using MyMindNotes means agreeing to that.

AI output is not reliable and you must check it. It can be wrong, and a transcript can mishear. What you send under your name is yours, however it was drafted.

Paying for it

Paid plans and credits are charged as shown at the time you buy them. TurboWorkflow takes payment through Razorpay or Dodo Payments and PaceForms through Paddle; those providers handle the card details and we never see them.

Fees are payable in advance and, unless the law where you live says otherwise, are non-refundable. Taxes are yours. If a payment fails or a subscription lapses we may suspend the paid parts of your account. We may change prices, and we will tell you before a change affects a renewal.

Availability

We work to keep Zocton running, but we do not offer a service level agreement or an uptime guarantee, and we would rather say so than publish a number we have not committed to measuring. The service may be unavailable for maintenance, a fault, or something outside our control.

We may change, add to or withdraw features. If we withdraw something you depend on, we will give you reasonable notice and a way to get your data out.

Keep your own copies of anything you cannot lose. TurboWorkflow takes account backups and can export your data; that is a convenience, not a guarantee, and it is not a substitute for your own records.

Suspension, and ending the agreement

You can stop using Zocton whenever you like. TurboWorkflow will delete your account from within the product: it is scheduled for deletion, you have fourteen days to change your mind, and after that everything is destroyed permanently and cannot be recovered. For the other products, write to privacy@zocton.com and we will delete the account for you.

We may suspend or close an account that breaks these terms — spam and abuse of the sending features most of all. Where we suspend an account we say why, and you can appeal in the product. Where the breach is serious, or where the law requires it, we may act without warning.

Ending the agreement does not refund fees already paid, and does not affect anything either of us owes from before it ended.

Privacy

The Privacy Policy forms part of these terms and describes what each product does with personal data. Where you put other people's data into a Zocton product, you are the controller of it and we process it on your instructions.

Warranties

Zocton is provided as is. To the extent the law allows, we exclude all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error free, that it will produce a particular business result, or that AI output will be accurate.

Nothing here excludes a liability that cannot lawfully be excluded, and if you are a consumer your statutory rights are unaffected.

Liability

To the extent the law allows, neither of us is liable to the other for indirect or consequential loss, or for lost profits, lost revenue, lost business or lost or corrupted data.

Our total liability arising out of or in connection with these terms is limited to the amount you paid us for the product in question in the twelve months before the claim arose.

You will indemnify us against claims arising from your use of Zocton in breach of these terms — in particular claims by people you contacted through TurboWorkflow, or whose data you collected through PaceForms, without a lawful basis.

Changes to these terms

We may update these terms. The date at the top changes when we do, and where a change materially affects you we will tell you inside the product or by email before it takes effect. Carrying on using Zocton after that means you accept the new terms; if you do not, stop using the service and ask us to close your account.

Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of India.

The courts at Pune, Maharashtra, India have exclusive jurisdiction over any such dispute or claim, and you and we both submit to them.

If you are a consumer, this does not take away the protection of any rule of the law of the country you live in that cannot be set aside by agreement, and it does not take away any right you have under that law to bring proceedings in the courts of the country you live in.

General

These terms, together with the Privacy Policy, are the whole agreement between us about Zocton. If a court finds any part unenforceable, the rest stands. Not enforcing something once does not waive it. You may not transfer this agreement without our consent; we may transfer it as part of a sale or reorganisation of the business.
